About crush injuries.

Accidents where someone becomes trapped or crushed are responsible for a significant number of work-related injuries each year. The consequences of these accidents can be devastating causing debilitating and long-term effects, requiring specialist medical care and rehabilitation as well as lengthy recovery periods and subsequent loss of earnings.

We have helped thousands of clients to pursue compensation for work-related accidents including those that have resulted in crush injuries caused by:

  • Falling objects: Falling objects can cause considerable harm when falling from a height and items falling from cherry picker baskets, scaffolding platforms or high shelving for example can all result in crush injuries.
  • Vehicles: Crush injuries can be caused by vehicles overturning, collisions or accidents where the operator becomes trapped between the vehicle basket or cabin and a fixed structure.
  • Industrial machinery and equipment: Construction, agriculture and manufacturing are just some of the industries where crush injuries can occur due to the machinery and equipment used.

Unfortunately, we see a wide variety of different types of crush injuries caused by preventable accidents at work. Fingers can become trapped, safety guards on tools may be missing or heavy machinery can overturn. Crush injuries can affect everything from fingers and toes to the limbs, torso, spine and head, potentially resulting in amputation, disability, paralysis or even fatality.

Accidents frequently occur in the workplace where the correct health and safety regulations are not adhered to. If you have been hurt whilst at work you need to take specialist legal advice to find out more about your entitlement.

As a Lexcel accredited law firm we regularly assist clients throughout England and Wales with accident claims of all types. Contact us today to find out more about the personal injury claims process.

About crush injury claims.

To be eligible for compensation your accident must have occurred in the past three years and have been caused in full or in part by somebody else. Your final pay-out will be dependent on the severity of your injuries, whether they are permanent or short-term and will consider the financial impact the accident has had on you.

Your compensation is owed to you for the pain and trauma you have experienced and to aid your recovery to put you back in the situation you were in before the accident.

It is there to provide access to:

  • Leading medical treatments including any surgery that may be required and rehabilitation therapy.
  • Private counselling sessions to help support your mental well-being and help you cope with the emotional load of your injury.
  • Any specialist equipment that may be required for your recovery or independence.
  • Adaptations that may be required to your home and vehicle.

The amount of compensation awarded is also there to cover:

  • Loss of earnings both now and in the future as a result of your accident
  • Additional expenses incurred such as travel to and from medical appointments.

Whether your injury is relatively minor and you are able to return to work fairly quickly, or whether you have suffered major, life-changing injuries you’re entitled to compensation and we can help to secure it for you.

Your right’s at work.

It is your employer’s responsibility to keep you safe at work and minimise any risk of an accident or injury. Their obligations include provision of a safe working environment, adequate protective clothing, equipment that is regularly inspected and serviced and adequate training for all members of staff.

Their failure to comply with the 1974 Health & Safety Act means that they are operating outside of the law and you can pursue a compensation claim. Your entitlement will cover medical treatment and rehabilitation, loss of earnings and additional expenses incurred as a result of your accident and injuries.

You may be feeling uncertain and anxious about pursuing legal action against your employer and worry how this might impact on your job and its security. The fact of the matter is that it is against the law for your employer to make you redundant, to make life difficult for you at work or to make you want to leave your role as a result of your claim.

You are fully protected by the law and we can provide advice on all aspects of employment law. Your employer will have employer’s liability insurance to cover any compensation claims made against them so they won’t be impacted personally by your claim.

Crush Injury Compensation FAQs

Crush injuries happen when the body is put under extreme force or pressure causing swelling, bruising, fracture and sometimes nerve injuries.

Crush injuries are common on building sites, in factories and in agricultural environments where large vehicles and heavy machinery use is common.

Accidents frequently occur in the workplace where the correct health and safety regulations are not adhered to.

They are often caused by falling objects, vehicles or heavy machinery.

Whether your injury is relatively minor and you are able to return to work fairly quickly, or whether you have suffered major, life-changing injuries you’re entitled to compensation and we can help to secure it for you.

Your employer has a duty of care to keep you safe at work.  If there is a failure in this obligation, you are likely to have a claim.

Employers are required to adhere to a range of safety measures in order to create a safe working environment, including providing proper training and adequate protective equipment.
