How To Make a Successful Injury Claim

It doesn’t matter if it’s an accident at work, a road traffic accident, an accident in a bar, pub, restaurant or any retail space, an injury on the public highways or a criminal injury; there are two questions we get asked by the majority of our clients. The order may vary, but the questions are always the same:

  1. How much could my claim be worth?
  2. What are my chances of winning?

Incidentally, we never get asked if it’s going to cost them anything, as we operate on a strict No-Win No-Fee basis. Which means that if the claim isn’t successful, then there’s never a single penny to pay.

So how do you know if you have a winning claim to make?

Well the first thing we’d say, is that having a winning claim and getting the right result will largely depend upon the experience and skill of the solicitor you choose to represent you.

Like most things in life, not everything is equal and some solicitors are just more specialised than others. The trick is, you need to make sure that your team is way more experienced and specialised than the ones representing the opposition.

As claims often run into tens of thousands of pounds in compensation, you can bet that the people responsible for your injury will throw everything at defending it, or try to negotiate a much reduced settlement.

Fortunately for you, as you are reading this, you’re in expert hands. As PSR Solicitors have been specialising in squeezing every drop of justice out of the people responsible for the injuries to our clients for decades. In fact, we would argue that appointing us sends a very strong message to the other side - and shows that you are serious about getting everything you are entitled to.

What kind of money might you be looking at?

Each claim is judged upon its own merits and circumstances, with different amounts being calculated accordingly. The simple answer to this question is to visit our claims compensation calculator, where you will get an indication of what your claim might be worth.

It’s always best to speak to someone directly and if you give us a call, or drop us an email, you’ll see that we are a friendly bunch, who are on your side from the very start. We’ll be able to give you a little more insight into what your individual claim may be worth, along with the timescales involved.

What are the chances of a successful outcome?

We’ve been doing this for so long, that we will be able to quickly let you know if you have a potentially winnable case or not. There are however a couple of initial considerations we can give you here:

  1. Can you show that any injuries that you sustained were caused by a particular accident?
  2. Was the accident itself was due to the mistake or negligence of someone else or the representative of a company?

Although these two points seem simple enough, proving them in a court of law can be complex and infuriating. Especially if the other party is contesting everything you say and is claiming to be without blame. Which is why you will need specialist professional help.

For a successful outcome to your claim we must be able to prove, on the balance of probabilities, that the defendant was indeed the one responsible for the cause of the accident where you suffered your injuries.

It sounds obvious, but hiring a professional firm of solicitors, instead of representing yourself or employing a less specialised firm, will have a dramatic effect on the final outcome.

How we build your case

The evidence that we use to present a strong and compelling case usually includes, but is not limited to, the following:

  • Photographs, for example of any injuries you received
  • Photographs of where the accident occurred, or the cause
  • If it was any kind of road accident, the police report could contain key evidence
  • For an accident at work, then we would refer to the report in the accident logbook
  • Medical records
  • Witness statements from people who saw the accident take place.

Don’t leave it too late - act now!

Please remember that there is only a three year limit from the date of injury, or date of knowledge, after which you cannot bring a claim

Evidence tends to be fresher and better preserved the sooner a case is commenced.

At PSR Solicitors, we understand the physical and emotional impact that being injured can cause. Especially when you were just going about your day-to-day business and the injuries were the fault of someone else’s negligence.

That’s why we’re so proud of our reputation for having a jargon-free, no-nonsense approach to injury claims. That always keeps the emotional, physical and financial needs of our clients at the centre of everything we do.

As we specialise in injury claims and have a reputation for success, appointing PSR Solicitors sends a clear statement of intent that you will not be fobbed off, or settle for anything less than you are entitled to.

If you have any questions regarding any points raised in this article or anything to do with injury claims in general, then please contact Richard Layfield, who heads up our Personal Injury Team, he’ll be delighted to help you in any way he can.
