In order to make a successful claim, and obtain the compensation you deserve following an accident that was not your fault, you will need to be able to prove your injuries and damages have occurred because of the negligence of a third party. It’s vital to establish clearly who is at fault, and to prove their negligence towards you.
Some of the evidence that can help build a strong case include:
Evidence from the scene of the accident, such as photos of the scene, damages, and injuries, will be crucial to proving the injuries and losses you have suffered. This may include CCTV of the area or dashcam footage of the accident if available.
If the mobility scooter accident involved other vehicles, noting down the details of all other drivers and vehicles is important.
Reports of your injuries, their severity and type, and details of any treatments should be documented throughout the process of your recovery. This can help calculate how much compensation you may be entitled to, and can also help figure out related costs - such as travel costs you have incurred to get to medical appointments.

According to the rules, wheelchairs, mobility scooters and powered wheelchairs are categorised as ‘invalid carriages’.
There are three classes of ‘invalid carriage’.
Mobility scooters are classified as either Class 2 or Class 3 invalid carriages, with only Class 3 being permitted to be used on the road. You do not require a driving license to be able to use either a Class 2 or a Class 3 invalid carriage, but you are required to register a Class 3 mobility scooter, irrespective of whether you intend to use it on the road or not.
Manual wheelchairs. These are not electrically powered and are propelled by either the user or an attendant. These are not permitted to be used on the road under any circumstances.
You can only drive this class of mobility scooter on the pavement. The only time that you are permitted to use these on the road is when crossing the road or in situations where there is no pavement. This type of mobility scooter is always restricted to a maximum speed of 4 mph.
Class 3 mobility scooters are permitted to be used on the road, assuming they meet the criteria detailed below. This class of mobility scooter will have a maximum speed of 8mph but must have a device to restrict the maximum speed to 4mph for use on the pavement.
It is important to understand that you could automatically forfeit all rights to make a compensation claim if you break any of the below rules whilst operating your mobility scooter.
