The Criminal Injuries Compensation Authority (CICA) was established in 1964 with the aim of compensating people injured through a criminal act such as assault. This is because more often than not the assailant cannot be traced or even if they are arrested and convicted, they may not have money or any form of insurance which would allow solicitors to pursue them directly.
The scheme offers set tariff awards for injuries which are not negotiable. There are 25 tiers of compensation that could be awarded, ranging from £1,000 to £500,000, with the option to claim additional care costs or loss of earnings. Currently, victims are not able to claim for loss of earnings for the first 28 weeks that they were unable to work and can only claim for any period they were unable to work after the 28 week period. The scheme also awards compensation to the relatives of people who have died as a result of a criminal injury.
While the majority of victims of criminal injury will be entitled to claim compensation for their injuries, there are certain eligibility criteria that need to be met for your claim to be successful. In the vast majority of cases, any claim must be made within 2 years of the incident occurring. There are exceptions to this rule, and we will cover these in our ‘Eligibility to claim’ section below. Another eligibility criteria that must be met in order to claim, is that the matter must have been reported to the police within 24 hours of the incident or else a claim cannot be pursued. In order to be entitled to make a compensation claim for your criminal injuries under the criminal injury compensation award scheme, certain eligibility criteria have to be met.
Firstly, the crime that resulted in your injury must have happened in either England, Wales, or Scotland. Northern Ireland and other countries have their own processes and eligibility criteria.
Secondly, the crime must have been reported to the police within 48 hours of the crime taking place, or as soon as is practicably possible.
Finally, the claim must be made within 2 years of the crime happening. There are exceptions to these time limits that will allow you to make a claim beyond the customary 2-year limitation date but for this to be the case one or both of the following will need to apply.:
Under the soon to be defunct rule known as the ‘same roof’ rule, you may also be entitled to make a claim if the crime occurred between 1st August and 30th September 1979 and you resided with the perpetrator as a family member at the time of the incident. This rule will no longer apply after 13th June 2021 and any claims made under this rule will need to be made prior to that date.
Nationality is also a factor in whether a victim is able to make a criminal injury claim under the scheme.
