Accidents can happen at anytime

In March 2022, whilst walking back to her car in The Co-op car park in Llandudno, our elderly client Mrs O, was reversed into by another car. As a result of this, Mrs O suffered a fractured hip and elbow, as well as other injuries. The matter was reported to the police and the driver was offered an Intensive Training Course and Practical Driving Assessment.

Mrs O was taken to Glan Clwyd hospital and later transferred to Llandudno Hospital, where she spent several weeks, due to the severity of the injuries she had suffered.

In April 2022, Mrs O contacted us and instructed us to act for her on this matter. It was obvious that her injury claim would exceed £25,000.00, which meant that the value of her claim would be higher than the maximum limit allowed for the Rapid Claims Portal.

Silence won’t make us go away

We wrote to the defendant and their insurance company and received no response from either of them. As a result of this lack of communication, we took action and obtained the police report of the incident. As it was clear that the accident was the fault of the careless driver reversing into our client, we then obtained a copy of the medical records relating to the incident. We also instructed a medicolegal expert, whose role it is to prepare a full medical report highlighting the injuries, treatments, loss and prognosis of the injuries Mrs O sustained. We also instructed a consultant orthopaedic expert to provide evidence in support of Mrs O’s case.

These expert medical reports confirmed the effect that the accident had on Mrs O and highlighted her courage to get out and about and resume her normal life. It also emphasized the fact that Mrs O now needed to rely upon the help and support of people just to carry on with general activities in and out of her home. Before the accident, Mrs O was able to enjoy venturing out and walking; and although her life would not be shortened by her injuries, her day-to-day activities had certainly been impacted. She was also unable to return to driving following the accident and reluctantly had to sell her car.

As well as the medical evidence we obtained, we also gathered evidence of financial losses and drafted a Schedule of Special Damages to support these. Including a large care and assistance claim, minor home adaptations, travel expenses and medical expenses in the form of chiropractic services.

See you in court – or not!

Once we had gathered all the documentation we needed to ensure the right outcome for Mrs O, we told the Defendant’s insurance company that we intended to take the matter to Court and were about to issue proceedings, as we had heard nothing from them since our original letter.

We drafted the Particulars of Claim, outlining our case, and then issued Court proceedings in November 2023 through the online Court process.

Almost immediately after we did that, the defendant's insurance company contacted us and made an offer of £85,000.00 for compensation. After consulting with the team here at PSR Solicitors, as well as the Barrister we were working with, and considering her age and status, Mrs O accepted the £85,000.00.

The whole matter was resolved quickly and with the minimum amount of fuss and further anxiety for Mrs O. Which was especially important given the large sum of compensation involved, together with Mrs O’s age and desire to move on and just enjoy the rest of her life.

Top tips about making a claim

Being involved in an accident is thankfully a rare occurrence. However, if it does happen and you think you’ve got a claim, then you’re going to want to speak to an expert who knows what they’re talking about. As the first thing that will happen, once the other side realises you don’t have expert legal advice, is that they will try and fob you off completely, or get you to accept a very low offer.
