About Pillion Passenger Accident Claims and Sidecar Injury Claims

Motorcyclists are considered to be one of the groups of vulnerable road users (VRU), mainly because they are not protected by a vehicle body but also because they are harder for other road users to see. Therefore, they are particularly vulnerable to injuries and have the highest accident and injury rates per mile travelled of all road user groups.

While some motorbike accidents may be relatively minor, resulting in injuries that will heal relatively quickly, other more serious accidents can lead to severe injuries that will have life-changing consequences and in some cases, may even lead to loss of life.

When riding as a passenger on a motorbike, it could be argued that the risks are even greater, as you have absolutely no control over the motorcycle. You are reliant on the motorcyclist to be observant of what is happening around them and have to trust them to ride in a safe, responsible manner.

Having a pillion passenger will dramatically affect the way a bike handles, increasing braking distances, altering the way it corners and changing the way the suspension performs. Failure to adapt to these changes increase the chances of an accident occurring.

Common risks for sidecar passengers include:

  • Lack of helmet - Sidecar passengers are not legally required to wear helmets, although it is recommended, so the potential for head injuries in certain types of accidents is significant
  • Steering - Ordinarily, much of the process of steering a motorbike involves leaning the bike around a corner. This is obviously not possible when the bike has a sidecar fitted, requiring much more use of the steering to change direction. Riders unfamiliar with riding a sidecar combination may not adapt to the change in technique, increasing the risk of being involved in an accident.
  • Geometry of setup - It is important that the sidecar is set with the appropriate geometry, failure to do so can dramatically affect the handling of the sidecar combination, increasing the risk of accidents and injury.

Although rider error is a significant cause of motorbike accidents it is far from being the only one. Many accidents can be attributed to the negligence of other road users or attributed to mechanical failure or a puncture. Road conditions can also play a significant role, with potholes or wet or icy roads dramatically increasing the chances of motorcycle accidents.

Making a pillion passenger or sidecar compensation claim

With years of experience in handling motorbike passenger accident claims, we have come to understand that these types of cases often involve the victim making a claim against a friend or sometimes, a family member.

It is rare that someone will ride in the sidecar of a stranger or agree to ride as a pillion passenger with someone they don’t know, so, in the event that your accident was caused by rider error, it is likely to be someone you know. While the prospect of making a compensation claim against a friend or family may not seem overly appealing, it is worth remembering that it is their insurance company, rather than them, that will be covering the cost of compensation. If your injuries are serious, you may have no choice but to make a claim, as you look to recover lost earnings, pay expensive medical bills, and make provisions for the future.

Alternatively, a mechanical failure or another road user may have been responsible for the accident that caused your injuries, in which case your claim would potentially be brought against the motorcycle manufacturer or the negligent road user.

Does a pillion or sidecar passenger always receive 100% compensation?

Although a motorbike passenger may have sustained injuries in an accident that they were in no way responsible for, there are certain circumstances where their compensation may be reduced due to something called contributory negligence.

For instance, if a passenger proceeded to get onto a motorcycle or climb into a sidecar, despite knowing that the motorcyclist was under the influence of alcohol or drugs, and if that rider then proceeded to have a crash, it could be argued that the passenger’s decision to get on the motorbike, knowing what they did, was a contributory factor in the injuries they sustained.

Another example is if the motorcyclist provided the pillion passenger with an appropriate BSA approved helmet, but the passenger decided not to wear it. If the medical opinion is that the injuries would be less severe had the passenger worn the provided helmet, then the compensation awarded to the passenger may be reduced.

Laws surrounding motorcycle pillion passengers

When a motorcyclist agrees to take a pillion passenger, they have a duty to take reasonable care of that passenger. That responsibility does not only start the moment they turn the key in the ignition, they also have an obligation to ensure certain conditions are met before the passenger even considers getting on the back of the bike or into the sidecar.

In the case of motorbike pillion passengers, motorcyclists have to ensure the following conditions are met before travelling.

  • They must provide you with a British Standards Authority (BSA) approved helmet
  • They must ensure their motorbike is fitted with an adequate pillion seat
  • They must ensure that your feet easily reach the footrests
  • Both parties must agree on a method of communication on the bike. This can be via intercom or through predetermined hand signals.
  • If it was your first time riding as a pillion passenger, then the motorcyclist also has a responsibility to ensure that you understand the risks associated with riding as a pillion passenger

Failure to meet any of the above conditions increases the risk of you sustaining a serious injury in the event of an accident and constitutes a breach of the rider’s duty towards ensuring your safety.
