Although a motorbike passenger may have sustained injuries in an accident that they were in no way responsible for, there are certain circumstances where their compensation may be reduced due to something called contributory negligence.
For instance, if a passenger proceeded to get onto a motorcycle or climb into a sidecar, despite knowing that the motorcyclist was under the influence of alcohol or drugs, and if that rider then proceeded to have a crash, it could be argued that the passenger’s decision to get on the motorbike, knowing what they did, was a contributory factor in the injuries they sustained.
Another example is if the motorcyclist provided the pillion passenger with an appropriate BSA approved helmet, but the passenger decided not to wear it. If the medical opinion is that the injuries would be less severe had the passenger worn the provided helmet, then the compensation awarded to the passenger may be reduced.
