The adult, known as the victim’s ‘litigation friend', can make a claim on the child's behalf at any time up to the date of the child's 18th birthday. If you are claiming on behalf of someone who doesn't have the mental capacity to claim for themselves, the time limit of three years does not apply. But if the person were to regain their mental capacity, they would have three years from this date to make a claim.
