About Criminal Injury Compensation Claims

The Criminal Injuries Compensation Authority (CICA) was established in 1964 with the aim of compensating people injured through a criminal act such as assault. This is because more often than not the assailant cannot be traced or even if they are arrested and convicted, they may not have funds or any form of insurance which would allow solicitors to pursue them directly.

The government funded scheme offers set tariff awards for injuries which are not negotiable. There are 25 tiers of compensation that could be awarded, ranging from £1,000 to £500,000, with the option to claim additional care costs or loss of earnings. Currently, victims are not able to claim for loss of earnings for the first 28 weeks that they were unable to work and can only claim for any period they were unable to work after the 28 week period. The scheme also awards compensation to the relatives of people who have died as a result of a criminal injury.

While the majority of victims of criminal injury will be entitled to claim compensation for their injuries, there are certain eligibility criteria that need to be met for your claim to be successful. In the vast majority of cases, any claim must be made within 2 years of the incident occurring. There are exceptions to this rule, and we will cover these in our ‘Eligibility to claim’ section below. Another eligibility criteria that must be met in order to claim, is that the matter must have been reported to the police within 24 hours of the incident or else a claim cannot be pursued. Also, if you have a criminal record then this can affect the award.

Criminal Injury Compensation Claim Eligibility

In order to be entitled to make a compensation claim for your criminal injuries under the criminal injury compensation scheme, certain eligibility criteria have to be met.

Firstly, the crime that resulted in your injury must have happened in either England, Wales, or Scotland. Northern Ireland and other countries have their own processes and eligibility criteria.

Secondly, the crime must have been reported to the police within 48 hours of the crime taking place, or as soon as is practicably possible.

Finally, the claim must be made within 2 years of the crime happening. There are exceptions to these time limits that will allow you to make a claim beyond the customary 2-year limitation date:

  • your claim relates to childhood sexual or physical abuse, and, or;
  • you were unable to make a claim any earlier due to your mental or physical state of health

Under the soon to be defunct rule known as the ‘same roof’ rule, you may also be entitled to make a claim if the crime occurred between 1st August and 30th September 1979 and you resided with the perpetrator as a family member at the time of the incident. This rule will no longer apply after 13th June 2021 and any claims made under this rule will need to be made prior to that date.

Nationality

Nationality is also a factor in whether a victim is able to make a criminal injury claim under the scheme.

In order to qualify, you must meet any the following at the time of the crime:

  • hold a British citizenship or be a EU or EEA national or be a close relative
  • a family member of an EU or EEA national who has the right to be in the UK
  • a member of the armed forces (or a close relative residing in their home)
  • an asylum seeker
  • a potential victim of human trafficking on or before the date of initiating your claim
  •  a national of any of the 47 countries that have signed up to the Council of Europe Convention on the Compensation of victims of violent crime.

You are also potentially eligible if you were ordinarily resident in the UK at the time of the crime. This depends on your connection to the UK, for example, if you were living, working or studying there (or you were related to an individual who was).

What Can I Claim Compensation For?

The nature and severity of the abuse and injuries you have suffered, both physical and mental, will be a key determining factor in which of the 25 amount of compensation tiers your claim falls into.

The scheme allows you to claim for the following:

  • physical injuries
  • disabling mental injuries - This is categorised as a mental injury that significantly affects your day-to-day performance at work or school, your relationships, or your sexual relationships. These types of injuries must be diagnosed by a qualified psychiatrist or clinical psychologist.
  • sexual or physical abuse
  • the death of a relative
  • paying for a funeral
  • loss of earnings and injury-related expenses

You will not be able to claim for any loss of earnings for the initial 28 weeks that you were unable to work, you can only claim for any lost earnings accrued after that time period.
