Once you have made the decision to buy your Council House you will need to contact your Council and commence the statutory application requirements. If you instruct us once your application has been accepted or at an early stage we can arrange with you to have the initial forms and necessary checks completed in readiness.
Once the offer has been agreed between you and the Council we will have the necessary information to hand to immediately start the legal process of purchasing your Council House without delay. The more quickly and smoothly the transaction runs the more quickly you will own your home.
Once we have received the contract pack from the Council’s legal department we can commence with searches, investigate the legal title to the property, and raise any relevant enquiries. Once we are satisfied with all the replies to our enquiries, the results of searches, and are in receipt of any required mortgage offer, a completion date can be proposed. Final confirmation from the Council that all rent is paid up to date will be required before completion can take place.
Should you require a mortgage on the property we will liaise with your mortgage lender, deal with their requirements, and request the mortgage funds in readiness for completion. We will pay for the searches and any stamp duty land tax on your behalf.
Please note that for a set period of time after buying your Council House you must first offer it back to the Council should you wish to sell it in the future. You may also have to repay your discount to the Council if you sell within a specified period.

There are a number of factors that can affect your Right To Buy discount. They include:
You will benefit from a significant discount if you have lived in the property for between 3 and 5 years - 35% for a home and 50% for a flat. This percentage will increase every year until it reaches 70%. If you are looking to purchase a house, this increase will be 1% yearly, while this grows to a 2% yearly increase for flats.
There is a limit to the total discount you can have: this equals £87,200 for all regions in England except London boroughs, which benefit from a Right To Buy discount up to £116,200.
You will be able to sell your home or flat if you have bought it under the Right To Buy scheme, although some restrictions will apply. If you decide to sell your property within 5 years of buying it, you will be liable to pay back part of the discount applied to your purchase.
The amount you must pay back depends on how long after the purchase you decide to sell. It will be 100% of the discount if you sell within 12 months, decreasing by 20% every year until the 5 year mark. The amount you owe will be adjusted to the value of the property at the time of your sale.
Once 5 years have passed since the purchase, you will be able to sell your home with no financial restrictions. However, if you sell within 10 years, you are obligated to offer to sell to either:

Should the landlord not agree to purchase the property within 8 weeks, you will be allowed to sell your house or flat to any buyer.
