Office Accident Claims
Offices can seem like a safe environment in which to work, that is why health and safety standards can slip.
Injuries from slips and trips are the most common form of accident at work.
In an office environment this is often caused by people tripping over phone or PC wires, falling over rubbish that has been left on the floor or slipping on spillages.
Common types of accidents include:
- cables from electrical equipment
- faulty electrical equipment
- objects left lying on the floor
- damaged carpets
- wet floors
Claiming against your employer
Employer's Liability Insurance is a legal requirement for most companies in the UK. It’s a special type of insurance that pays compensation to employees who are injured in the workplace. In the event of an accident in the workplace it is usually the employer's insurance company who would pay compensation.
Your employer has a legal obligation to provide you with a clean and safe working environment, proper equipment and also to ensure that staff have been fully trained on all aspects of their job.
This includes being fully trained on health and safety at work. If they fail in their duty to look after you whilst you are working for them then they can be held to account by the law. No one should ever have to go to work and suffer an injury or death.
We understand that you may feel uncomfortable about making an office accident claim against your employer, particularly as you may have concerns over job safety. However, your employer cannot dismiss you if you are injured due to their negligence in the workplace and they must have insurance in place to cover them. They won’t have to pay you compensation themselves.
Our experienced solicitors can help you with a wide range of office injury claims such as:
- Electrical accidents as a result of the improper installation of electrical equipment including phones, lighting, leads, computers, printers etc
- Slips, trips and falls caused by tripping hazards in walkways and slippery surfaces for example.
- Accidents as a result of poor health and safety training
- Injuries to fingers or hands due to dangerous office equipment such as shredders, photocopiers, guillotines, staplers or scissors
- Back injuries from lifting heavy items
- Repetitive strain injuries
- Posture problems caused by poor workspace design, inadequate office furniture or inadequate training.
What to do after an accident
If the employer admits responsibility for the office accident, the chances of a successful claim are very high.
There are a number of things that can be done to help build a strong case:
- keep a record of the events
- take photos and/or video of the cause of the accident
- record the incident in the accident log book
- get the contact details of any witnesses
- go to the Doctor so that your injuries are recorded in your medical history
- if necessary, report the incident to the HSE or check the employer has done so
Will I still be able to claim for an office injury after the law changes in April 2020?
From April 2020, personal injury claims under £2,000 (£5,000 for road traffic accidents) will be heard in the small claims court. You will still be able to make a claim, but it is very unlikely that you would be able to engage a solicitor to represent you. There are plans for an official online system which would provide some assistance to those representing themselves, but there has been no progress with this as of January 2020.
If you are looking to claim office injury compensation and you want free legal advice from a fully qualified solicitor then please contact us now. Using one of our specialist solicitors ensures that you have a better chance of winning your claim and receiving all of the compensation and help that you are entitled to.
