About Shopping Accident Compensation Claims

When people go shopping, they enter a shop on the understandable assumption that they will be safe and secure and there is legislation designed to ensure that this is the case.

Under the Occupiers’ Liability Act 1957, business owners, including shops, are legally required to ensure you’re kept as safe as possible when visiting their premises. Shop owners and managers are required by law to follow strict safety regulations set out by the Health and Safety Executive, failure to adhere to these regulations means that they are potentially putting you at risk and may therefore be responsible for any injury sustained on their premises.

When we are shopping, shop owners and those in charge of the day-to-day running of the store know that we are generally concentrating on the products on their shelves, rather than necessarily paying attention to where we’re going and what’s in front of us, and that’s how they would like it. There is, therefore, a responsibility on the shop owner or manager to ensure that potential obstacles, such as packaging, or hazards, such wet floors, are cleaned, dried, or removed as soon as is realistically possible.

Failure to place appropriate warning signs/notices when the shop owner anticipates a potential danger would also be seen as a breach of their duty of care to customers.

Some shops have ‘atmospheric’ lighting to set a mood in the store, others have inadequate or poorly maintained lightly. Poor lighting of any form can pose a risk to customers, especially near steps and stairs.

I completed my law degree and legal practice course at Nottingham Law School, before qualifying as a solicitor in 2004. I then worked at a specialist personal injury firm in the East Midlands and a leading regional firm, before joining PSR in 2017.
