Has the process changed in 2021?

With the introduction of the Official Injury Claim (OIC) portal in 2021, the system to make low value road traffic injury claims has been effectively revolutionised. The new law outlines specific fixed tariffs, with a focus on soft tissue injuries such as whiplash.

Small claims made through the OIC must have a general damages value below £5,000. However, vulnerable road users are subject to different rules when it comes to the monetary value they can claim through the OIC.

As motorcyclists are considered vulnerable road users, they can only submit a claim through the OIC if it’s valued below £1,000 in general damages.

If your claim is valued at more than £1,000, you should start the process of claiming compensation independently, with a solicitor of your own choice. This will allow you to receive the maximum amount of compensation.

How much time do I have to make a Motorbike Accident Claim?

For most claims, you have three years from the date of the accident or three years from the date that the injuries become known, as noted in Section 11 of the Limitation Act 1980. However, there are certain exceptions to this which includes:

If the person injured in the accident involved a child. A parent or guardian can make a claim up until their 18th birthday, and the claimant will have a further 3 years from their 18th birthday to make a claim themselves.

If there is a fatal injury involved. Provided that the 3-year time limit has not expired within the lifetime of the deceased, loved ones can make a claim for three years following the date of death.

If the person injured is receiving treatment under the Mental Health Act 1983 at the time of the accident, the three-year period will start when the patient is discharged.

What is the compensation claim process?

The compensation process can appear complex, but our experienced solicitors have helped many bikers and pillion passengers make successful claims for their injuries. We will simplify the process for you and guide you through.

  1. Assessing who was responsible for your injuries. This is sometimes very clear, but can be more complicated,if numerous vehicles were involved, or if mechanical faults played a part. Usually, we will claim against their insurers which requires further investigation.
  2. Collecting evidence. We will ask you what happened, including where it happened, any witnesses, how it occurred and who you think is responsible. Don’t worry if you can’t remember everything, we will carry out further investigations. If the police are involved, we will speak to them and use video evidence from CCTV for example.
  3. Identifying the extent of your injuries. We will assess your injuries as well as how they have affected your life. We will, with your permission, access your medical records if you have been to the GP, and also ask for photos of any visible injuries. We will arrange a medical assessment and identify how long the injuries are likely to last.
  4. Organise any medical care that you need. Your health is the priority, and we will help to make sure that you receive the best quality medical assistance. We will ask you what your goals are in recovery and help you to achieve them in the fastest time possible.
  5. Work out compensation amount. When all of the evidence has been collected and we have reviewed how your recovery is going, we will calculate how much compensation you should get. This will take into account a wide range of factors, such as your injuries, medical treatments, travelling costs, financial losses and any adaptive equipment required as a result of the accident.
  6. Reaching a settlement. We will then work with the people who you are making the claim against to reach a figure which is acceptable for you. We will consistently communicate with you and it will be your choice as to whether the figure is accepted or not. If an agreement cannot be reached, we will take the matter to court but this is more rare due to added costs for the third party.
  7. Receiving compensation. When an amount has been settled, you will then receive the compensation. This will usually be in one sum, however the courts may decide that this should be in monthly or yearly instalments if it is required for long-term care.

 

In some circumstances, you can make a Motorbike Accident Claim on behalf of someone else. For example, if the injury involves the head, brain or spine, the person may not have the mental capacity to make a claim themselves. If this has happened, a family member or loved one can make the claim on their behalf as a ‘litigation friend’.

If your loved one unfortunately passed away from a motorbike accident, you could still make a claim. The money received could cover bereavement, funeral costs and money for dependents.

If the responsible driver is uninsured or fled the scene, you can still make a motorbike accident claim. PSR Solicitors will work with the Motor Insurer's Bureau (MIB) to ensure you receive the compensation you deserve. Meeting certain criteria is necessary, including reporting the accident to the police and making a claim with the MIB within nine months.

The short answer is yes. You can make a claim against whichever authority is responsible for ensuring roads are surfaced correctly if your accident was caused by damaged roads.

Authorities have a duty of care towards drivers to ensure that the roads are safe to drive on. By law, they are required to conduct regular inspections of roads to ensure that there are no dangers to road users. If there are any hazards on the road, there should be signs warning drivers.

If the accident was partially your fault, you could still make a claim. The responsibility of the accident can be shared between parties. When we are assessing your claim, we will identify your part in causing the accident, and if you are also at fault, a split liability agreement will be set up. This means that you will receive a percentage of the compensation that you would have received if the third party was fully at fault. For example, if you were 25% responsible, then you will receive 75% of the total compensation.

Common types of Motorbike Accident Claims

Motorcyclists are among the most vulnerable road users. Unlike cars with protective features, motorbike riders rely on helmets, gloves, boots, and protective gear to shield themselves. However, even with these precautions, motorcycle accidents can result in severe injuries, both physically and psychologically.

According to the road safety charity Brake, bikers are 63 times more likely to be seriously injured or killed in an accident than car drivers, and are significantly more likely to be affected by damaged road surfaces. The consequences of a motorcycle accident are often life-changing.

Some of the most common motorbike accidents involve:

  • Drivers not seeing motorbikes in their mirrors
  • Drivers moving lane without looking in their mirrors
  • Drivers overtaking without realising there is a motorbike there
  • A biker needing to take sudden action to prevent hitting a pedestrian
  • Damaged road surfaces, such as potholes or fluid on the road, causing an accident
  • Broken traffic lights or lack of signs causing an accident

Motorbike accidents are split into two categories depending on which part of the bike is affected. These are:

  • Lowside accidents: This is where one of the wheels loses a firm grip on the road and you lose control, usually caused by excessive braking or accelerating too much. This could lead to the biker falling off and having bad bruises and broken bruises. However, it could also lead to the rider going into traffic, which could have much worse consequences.
  • Highside accidents: This occurs when the back wheel loses traction and then regains it. This momentum forces you off the bike and can lead to serious injuries, as you are forced forward.

No Win No Fee Motorbike Accident Claims

Before you make the claim, you will enter a Confidentiality Fee Agreement (CFA). This means that there is only a fee if your claim is successful, giving you peace of mind that there is no risk of losing money on your behalf.

If your claim is successful, the defendant's insurance company will pay most legal costs, and we will take an agreed fixed percentage of this.

For your own protection, we will take out an After The Event (ATE) insurance policy, which means that in the very rare instance that your claim isn’t successful, the costs will be covered and there will be no financial burden on your end.

What should I do after a motorbike accident?

There are a number of precautions you can take immediately following a motorbike accident to help your future claim. Anything that helps establish the other party's fault, your injuries, and your losses and damages can support your legal case when you begin the claims process. On the scene of the accident, you should:

  • Assess the injuries, and alert the emergency services if necessary. The physical well being of all involved should be a priority
  • Collect evidence. Take pictures of damages to your motorbike, your equipment, and property.
  • Make notes of the personal details of all involved. This includes the other parties involved in the accident and all possible witnesses that may make a statement regarding the events.
  • Inform the authorities of the accident. Their statement is going to be fundamental for your claim.
