About Mobility Scooter Accident Claims

To people with mobility issues, scooters are an essential piece of equipment and allow users to have a level of independence that they could not otherwise have. When people are involved in a mobility scooter accident, it can often have significant physical and psychological effects, causing injuries that further compound their mobility problems and eroding their confidence in something that has afforded them a level of independence.

Whilst all manufacturers of mobility scooters are required to carry out rigorous testing prior to releasing a scooter onto the market, as with most things, they are not immune to faults. In instances where the fault affects the steering mechanism or the electromagnetic brake, the consequences can be disastrous., especially if the fault occurs whilst the scooter is being used on the road.

Whilst some restrict the use of their mobility scooter to the pavement, others use them on the road, leaving them vulnerable to other road users. Because a mobility scooter offers relatively little protection to the user, any collision involving another vehicle is likely to lead to injure those involved. Sadly, not all drivers are considerate towards scooter drivers, often failing to give them sufficient space when overtaking and allowing insufficient time for them to complete a manoeuvre on the road.

The environment can also be a contributing factor in mobility scooter accidents, with uneven paving slabs, potholes or damaged drains increasing the risk of a mobility scooter toppling over or crashing.

You could be entitled to compensation if you suffered damages because of a mobility scooter accident. This includes damages to your vehicle, if these have occurred as a result of the negligence of the driver of the scooter or another third party.

You may need to make a claim against the mobility scooter’s user’s insurance provider, or the entity in charge of road maintenance if this is what caused the accident.

What can you claim for if you are injured in a mobility scooter accident?

As with any form of personal injury claim your total mobility scooter injury compensation award will consist of two key elements, General Damages and Special Damages.

General damages are calculated based on the nature and severity of your injuries and are designed to recompense you for the pain, suffering and loss of amenity that you have endured as a result of the injuries, and will consider factors including:

  • the physical pain and suffering that you’ve endured as a result of your injuries
  • the mental distress that your injuries have caused
  • the loss of amenity that you have suffered - considered the loss or reduction in the victim’s ability to accomplish physical or mental tasks they were capable of prior to the injury.

As well as the General Damages, calculated using the guidelines providing by the Judicial College, you can also claim for Special Damages to recover any injury-related expenses or losses, including:

  • Medical treatment – Your injuries may require specialist treatment not available on the NHS and may require you to have short-term or long-term home care. If you can prove that the accident was somebody else’s fault, then you will be able to recover these costs.
  • Medical transport costs – You can claim back any transport cost for medical appointments.
  • Repair or replacement of mobility scooter – Chances are that if you were involved in an accident on your mobility scooter, you are going to need to have it repaired or replaced. These costs can be recovered.
  • Loss of income – If your injury requires you to stay off work, either temporarily or permanently, then you can claim for loss of income. You can also claim for loss of things like commission, bonuses, lost promotion opportunities and pension effects.

Common Causes of Mobility Scooter Accidents

Sometimes, despite observing all the rules governing mobility scooters and having driven carefully, accidents still happen. There are four main types of mobility scooter accidents.

They will cause the driver to lose control of their mobility scooter, with the potential to hit someone or something or even worse, cause them to swerve onto the road or topple over.

If you have your mobility scooter serviced or have taken your scooter in for repair, there is a chance that the engineer has forgotten to adequately retighten a nut or has used a non-standard part to repair your scooter. If this is the case, then you may be able to make a claim against the company that carried out the repairs.

Caused by damaged road surfaces, uneven pavements or defective drain grids, these types of accidents can lead to the driver being thrown off the scooter or can cause the scooter to topple over, trapping the driver underneath and causing injury. In the most severe cases, a pothole may cause a puncture or damage to the steering, making the mobility scooter swerve into passing traffic.

Are there time limits to make Mobility Scooter Accident Claims?

As is the case with most personal injury claims made in the UK, you must start legal proceedings within 3 years of the accident, or from the date of discovery. This is the date in which your injuries have been diagnosed, or when their full extent has been determined.

What evidence do I need to support a Mobility Scooter Accident Claim?

In order to make a successful claim, and obtain the compensation you deserve following an accident that was not your fault, you will need to be able to prove your injuries and damages have occurred because of the negligence of a third party. It’s vital to establish clearly who is at fault, and to prove their negligence towards you.

Some of the evidence that can help build a strong case include:

Visual and photographic evidence

Evidence from the scene of the accident, such as photos of the scene, damages, and injuries, will be crucial to proving the injuries and losses you have suffered. This may include CCTV of the area or dashcam footage of the accident if available.

Driver and vehicle details

If the mobility scooter accident involved other vehicles, noting down the details of all other drivers and vehicles is important.

Medical reports

Reports of your injuries, their severity and type, and details of any treatments should be documented throughout the process of your recovery. This can help calculate how much compensation you may be entitled to, and can also help figure out related costs - such as travel costs you have incurred to get to medical appointments.

Details and statements from witnesses

If anyone not involved in the accident has witnessed the event, you should take note of their details. They may be able to submit a witness statement to strengthen your case.

 

Rules regarding mobility vehicle use in the UK

According to the rules, wheelchairs, mobility scooters and powered wheelchairs are categorised as ‘invalid carriages’.

There are three classes of ‘invalid carriage’.

Mobility scooters are classified as either Class 2 or Class 3 invalid carriages, with only Class 3 being permitted to be used on the road. You do not require a driving license to be able to use either a Class 2 or a Class 3 invalid carriage, but you are required to register a Class 3 mobility scooter, irrespective of whether you intend to use it on the road or not.

Manual wheelchairs. These are not electrically powered and are propelled by either the user or an attendant. These are not permitted to be used on the road under any circumstances.

You can only drive this class of mobility scooter on the pavement. The only time that you are permitted to use these on the road is when crossing the road or in situations where there is no pavement. This type of mobility scooter is always restricted to a maximum speed of 4 mph.

Class 3 mobility scooters are permitted to be used on the road, assuming they meet the criteria detailed below. This class of mobility scooter will have a maximum speed of 8mph but must have a device to restrict the maximum speed to 4mph for use on the pavement.

  • a maximum unladen weight of 150kg
  • a maximum width of 0.85m
  • a device to limit its speed to 4mph
  • a maximum speed 8mph
  • an efficient braking system
  • front and rear lights and reflectors
  • direction indicators able to operate as a hazard warning signal
  • an audible horn
  • a rear view mirror
  • an amber flashing light if it’s used on a dual carriageway

It is important to understand that you could automatically forfeit all rights to make a compensation claim if you break any of the below rules whilst operating your mobility scooter.

  • Right of Way - As stated in the Highway Code, pedestrians always have right of way on pavements and you must show due consideration to other pavement users, particularly those with visual or hearing impairments.
  • Speed Limits - Both Class 2 and 3 mobility scooters are restricted to a maximum speed of 4 mph on the pavement and Class 3 scooters are restricted to a maximum speed of 8mph on the road.
  • Lights, indicators, and horns - You must follow the same rules as any other road user when it comes to lights, indicators and horns and lights MUST be used at all times at night.
  • Direction of travel - Any person driving a Class 3 mobility scooter on the road must ensure that they are travelling in the direction of the traffic at all times.
  • Road type - Mobility scooters are not permitted on motorways and should not be driven on unrestricted dual carriageways where the speed limit exceeds 50mph. If they are driven on a dual carriageway, an amber flashing light must be on at all times.
