How is the value of your Car Accident Compensation Claim calculated?

The table follows guidelines for injury compensation settlement amounts as stipulated by the Judicial Board Guidelines. Specifically, these compensation guidelines focus on the severity of your Personal Injury and the physiology surrounding your particular injury. Car Accident Injury Claims are divided into two distinct parts General Damages and Special Damages. The tool bases compensation values solely on the first category.

General damages, which seek to compensate for the pain, suffering and loss of amenity caused by injuries sustained in the accident, are directly related to what types of injury you have sustained and the severity of such injuries to specific parts of the body. Car Accident Compensation Calculator values often consider the likely impact on your future well-being depending on the degree of injury, when presenting compensation settlement amounts.

You may also be awarded Special Damages, which examine any financial loss, or future financial loss that may incur as a direct result of the accident. This can include financial compensation for lost earnings if an injured person cannot return to work, and will obviously cover the damage to any property, including your vehicle. Special Damages will go on to include additional expenses that you may have incurred because of your injury following a road traffic accident, such as travel costs and medical bills, etc.

Other factors must be taken into account as future implications that may include long-lasting debilitating physical health problems that could stop you from working. There are many more long-term implications that need careful consideration if you have been left with life-changing injuries.

Special Damages would generally include:

  • Medical bills such as treatments, therapy, surgeries and medications
  • Travel expenses, (possibly the result of having to attend medical appointments), due to the loss of a vehicle
  • Repairs to, or replacement of, your vehicle
  • In the most severe cases your home or next vehicle may need modification vehicle
  • Mobility aids
  • Financial losses from being unable to return to work

Do not leave anything to chance. Call PSR Solicitors today for the best advice and representation in respect of your health and financial well-being. We can assist you right through the injury claim process while also ensuring your recovery and wellness are totally catered for.

Why Make a Car Accident Claim?

Even minor accidents can cause significant stress, both emotionally, psychologically, and financially. Making a personal injury claim is a way to help you get back to the same position you were in before the accident, as much as possible.

If you've suffered a physical injury in a road traffic accident, such as whiplash or broken bones, you may need medical treatment to recover fully. NHS waiting lists can be long, and private treatment can be costly. By making a Car Accident Claim, you can ensure that you have access to the necessary medical treatment, funded by the insurance company of the at-fault party.

Being unable to work due to injuries from a road traffic accident can result in a loss of earnings and other out-of-pocket expenses. Compensation is designed to ensure you don't suffer financially due to someone else's negligence.

If your quality of life has been affected by the accident, you should be compensated. This includes being unable to perform daily tasks or engage in your usual activities. Compensation recognises the pain and suffering you've experienced as a result of the accident.

How do I secure the highest Car Accident Compensation payouts?

There are many factors that must be considered when calculating your potential settlement amount. First, you should make sure to follow the proper protocol immediately following your accident: this will ensure you minimise your injuries and damages, and have a strong body of evidence in the event of a compensation claim.

  • Make sure every person involved in the accident is safe; contact the emergency services if necessary, such as accidents resulting in serious injuries.
  • Try to remain calm. Temporarily reduced mental capacity caused by the shock of an accident is common. Avoid apologising or admitting guilt.
  • If you are able to, move the car to a safe location and inspect the damages. This is also the time for you to take photographs and collect evidence.
  • Exchange details such as name, contact details, insurance company information, and vehicle registration number.
  • Seek medical advice, even if you do not feel injured. Some injuries may only present symptoms hours after the accident.
  • Contact a legal expert as soon as it is convenient, as the time limit on personal injury claims makes it a priority that you act fast on your compensation claim.

Following our initial conversation with you, we will be in a much stronger position to more accurately understand what amount of car crash compensation payout you can expect based on your injury sustained during the road traffic accident.

Once we have talked, we will also be able to advise you properly on whether you have a claim for injury compensation, and we will be able to describe what must happen if you are intent on starting proceedings toward recovering compensation. Please remember that we work on a No Win, No Fee basis. This means you do not have to worry about money or funding legal fees while your case matter is brought to a conclusion.

If you want to proceed with your compensation claim, we will require access to medical records for review and examination by our specialists. PSR Solicitors can also call on specialist medical expertise should injuries be complex, either due to severity or, existing underlying health matters.

RTA Soft-Tissue Compensation Fixed Tariffs as of 1/6/21

If your case is successfully concluded for under £5,000.00 then you will receive compensation subject to the fixed legal costs as set out below. These fixed legal costs are calculated based on the separate awards for both your tariff and non tariff injuries. If your case is unsuccessful then you will obviously receive no compensation but you will have no legal costs to pay.

Legal costs relating to tariff injuries are fixed and are calculated based upon the level of compensation that your tariff injury qualifies for.

The injury tariff is set by the Government and is shown in the table below.

Compensation Guide

New Regulations on Compensation Calculation for Soft Tissue Injury Following a Car Accident

Compensation Calculator

The figures detailed above are non-negotiable, they are a set tariff which the government has introduced.  Compensation awards for soft tissue injuries resulting from a car accident are now approximately only 25% of the value of compensation awards made for accidents before the 1st of June 2021.

Personal injury clients will be sent for a medical examination where the examiner will indicate a likely recovery period.  The Medical expert decides and records in his report - the fixed amount of compensation you will receive.

Please note that this only applies to soft tissue injuries following a car accident that occurred after the 1st of June 2021.

Legal Costs Relating to Non-Tariff Injuries

Legal costs relating to non tariff injuries are additional to the above fixed costs for tariff injuries are fixed and are calculated based upon the level of compensation that your non tariff injury receives:

Non tariff injury value                                    Costs

Up to £1000.00                                                   £250.00

Between £1000.00 and £2,000.00                £500.00

Between £2000.00 and £3,000.00                £750.00

Between £2,000.00 and £4,000.00                £1000.00

Between £4,000.00 and £5,000.00                £1250.00

Legal Costs for Injury Awards above £5,000

If the tariff and non tariff compensation awards exceed £5,000.00 then your case will no longer be subject to the Fixed Legal Costs as outlined above.

Instead, you will receive compensation subject to the agreed deductions as set out in the Conditional Fee Agreement and limited to a total of 25% of the damages you receive. If your case is unsuccessful then you will obviously receive no compensation but you will have no legal costs to pay.

Our costs are inclusive of VAT.

If you or a member of your family have sustained major or minor injuries as a result of being involved in a road traffic accident or crash that involves other drivers, then you may be entitled to claim compensation for your loss and injuries. Even where you may have been at partial fault in causing the accident or could have taken positive action to minimise the effects of the accident, you could still be in a position to claim compensation.

It is the best course of action to speak with one of our specialist Car Accident Injury Lawyers at the earliest convenience. Having these discussions immediately (or at least as soon as you or a loved one is able to) is likely to be best as the incident will still be fresh in the mind. That being said, a time limit of 3 years is generally understood as the timeframe in which a claim must be made.

Not wearing a seatbelt, as well as avoiding any reasonable actions to prevent injury, can be considered “contributory negligence”. You can still get compensation for a car accident injury, however the amount you will be awarded may be affected.

You may be able to get compensation for an accident if it is proven that a third party is to blame for any damages you have suffered. This may include situations in which some of the fault falls on the claimant. It is important to seek advice from specialists, as accidents with unclear liability can become very complex.

In cases in which the driver cannot be easily identified, such as car crash claims for accidents involving uninsured drivers or foreign vehicles, the Motor Insurers’ Bureau (MIB) may step in. The MIB can help you track down the other party’s insurers, and handle communication when necessary. If you have been injured in a car accident involving an uninsured road user or a vehicle registered abroad, contact us today, and we can help you manage communications with the MIB and the other party’s insurer.

As with most cases of personal injury claims in the UK, your case will likely be subject to time limits. The general rule limits injury claims to 3 years from the date of the accident, however there are a number of exceptions you may benefit from. If you're unsure about the validity of your car accident claim, contact PSR Solicitors for an assessment of your case.
