Successful Bus Passenger Injury Compensation Claim

We were instructed by Miss R, who was a passenger on a bus when she suffered injuries.

The client’s usual bus stop had been closed due to construction work, so she stood up to ask the driver if he could pull over before the next stop. As she was standing, the driver braked sharply, causing the client to stumble and fall against the luggage rack.

Sometimes bus drivers need to brake suddenly, such as to avoid causing injury to someone who has run into the road or to avoid a collision with another vehicle.  However, on this occasion there was no such good reason and the driver knew our client was standing up so she would be at risk of injury if there was a sudden movement.

Sometimes people fall and suffer injury as the bus pulls away before they have had a chance to sit down, but this in itself would not necessarily give rise to grounds for a claim; the driver would need to realise that the passenger was particularly vulnerable to that happening.

The chances of a bus claim succeeding are very fact specific; if you have suffered an injury you should contact us to discuss the precise circumstances so we can weigh them up and advise you accordingly.

As a result of the accident, our client suffered injuries to her neck, ankle and leg, as well as headaches and anxiety, plus some modest financial losses.

We obtained a report from a suitable medical expert and we valued her claim at around £2,500 to £3,000. We entered into negotiations with the bus company’s insurer and were able to reach a settlement of £3,810, which exceeded the client’s expectations.
