Our client, a 52-year-old police officer from Neston, contacted PSR Solicitors after sustaining multiple injuries in a road traffic accident. As someone with a physically demanding job and a longstanding commitment to personal fitness, he had been out on a routine early morning run when the collision occurred.
The incident took place on Deeside Industrial Estate in low-light conditions. Our client was wearing appropriate high-visibility gear, including a headtorch and reflective running clothing, to ensure he remained visible to passing vehicles. As he crossed a quiet junction, a vehicle unexpectedly turned in and struck him, causing him to fall and hit the ground with force.
Despite taking every reasonable precaution for his safety, he sustained serious injuries as a result of a driver failing to take appropriate care.
The collision left him with a head wound involving both the forehead and ear, which led to ongoing tinnitus. He also sustained soft tissue injuries to his neck and back, with symptoms that continued for several months after the incident. Over time, he developed psychological symptoms consistent with trauma from the experience.
Although his recovery was positive overall, he was unable to return to his previous level of physical activity. This had a significant impact on his daily life, routines and long-term wellbeing.
The client instructed PSR Solicitors within a month of the accident. We acted quickly to initiate the claims process, requesting third-party details through appropriate channels and submitting a formal claim to the defendant’s insurer.
Initially, the insurer failed to respond on the issue of liability. Nevertheless, we proceeded with gathering medical evidence to support the strength of the claim. An orthopaedic expert was instructed to assess the musculoskeletal injuries and confirmed the nature and extent of the damage. This report recommended further assessments with an ENT consultant for the tinnitus, a plastic surgeon for scarring, and a psychologist for the emotional trauma.
The insurer objected to these referrals, but we confirmed that we would be proceeding regardless, based on clinical necessity and the overall seriousness of the injuries.
Within the same week, the insurer made a pre-medical settlement offer. While early offers can sometimes be premature, we reviewed it carefully in light of the Judicial College Guidelines, the orthopaedic opinion, and the nature of the ongoing symptoms. We advised the client that, in our view, the offer reflected a fair and appropriate level of compensation.
The claim was settled within eight months of instruction, without the need for court proceedings. A total settlement of £25,000 was secured, resulting in £18,750 net of legal costs for the client.
The compensation reflected the injuries sustained, the disruption to his lifestyle, and the psychological effects of the collision. The client was able to move forward with the reassurance that what he had been through had been taken seriously, and that the harm he suffered had been properly recognised.
