Our client was walking home from school with others. The claimant commenced crossing the road whilst doing so a third party vehicle drove into collision with her right hand side. Police attended and the claimant was taken via ambulance to Hospital and was admitted for one night. The claimant had one week off school.
We received instructions in relation to this matter in July 2017 and submitted the claim to the defendants. Liability was denied in this matter as the Defendants blamed the Claimant for causing the accident by running into the road.
However, upon considering the medical records, police documentation and Claimant’s account we were happy with prospects of success so instruct a medical expert to provide a medical report.
We issued the claim in court in January 2019. In March 2019 we received a Part 36 offer of £1,750 from the Defendant’s and thereafter instructed counsel to advise on quantum. Given the matter involved a child we instructed a barrister to provide an advice on prospects and quantum. Counsel deemed in light of the litigation risks in taking the case to trial the offer should be accepted.
In June 2019 the offer was subsequently agreed. An Infant Approval Hearing was thereafter listed for the 8th August 2019 and the court approved the settlement and the defendants were ordered to pay the funds into the Court Funds Office.
