PSR Solicitors of Wrexham successfully obtained £10,000.00 for a spectator who was injured whilst watching an auto grass motorsport race in Chester. The injury occurred when a vehicle that was racing around the auto grass track dislodged a rock which subsequently hit our Client’s shin causing her to suffer an open fracture.

As a spectator the client had implicitly consented to some level of risk (for example accidentally being hit in the face with a football at a match).  However, this does not apply if negligence was involved (a player deliberately kicking a football at someone). Here the accident could have been prevented had the Defendant erected the appropriate fencing around the track. This would have stopped stones and other debris shooting up and hitting spectators.

We put forward our case to the Defendant’s insurance company who denied liability. Medical evidence was obtained and Court proceedings were issued due to the Defendant’s denial of liability. A trial was listed to take place in May 2017 but following negotiations between the parties compensation was agreed for our Client in the sum of £10,000.00
