Our clients were a married couple navigating the early stages of a recent dementia diagnosis. While one of them remained fully capable of making decisions, they both recognised the importance of putting legal safeguards in place while they still could.
Prompted by the diagnosis, the couple contacted PSR Solicitors for guidance on Lasting Powers of Attorney (LPAs). Their priority was to act swiftly, ensuring that the right legal documents were in place should the condition progress and decision-making capacity become impaired. One of the main concerns was how to protect and manage assets that were held solely in the name of the client with the diagnosis. The couple also wanted clarity on the two different types of LPA – one covering property and financial affairs, and the other health and welfare – and whether both were necessary in their situation.
Facing a dementia diagnosis is emotionally challenging. However, taking legal steps early brought the couple a sense of relief and reassurance. Knowing that they had appointed trusted attorneys to act on their behalf, if needed, gave them confidence and control during a difficult time.
Following an initial phone call for a quote, the couple made an appointment with our Wills and Probate team. We carefully took instructions, drafted both types of LPA, and met with them again to ensure the documents were properly signed and witnessed. Once the LPAs were registered with the Office of the Public Guardian, we provided certified copies for their records and securely stored the originals.
