PSR Solicitors in Colwyn Bay were instructed by a client who was previously being represented by another firm of solicitors, which was closed down by the Solicitors Regulation Authority. The client had suffered a serious injury at work resulting in the amputation of parts of his right middle and ring fingers, with other damage to the hand and associated psychological injury.
At the point when PSR Solicitors took over the case the claimant was part way through medical treatment. His injury prevented him from working, so he was not earning. By that point the defendant had made an offer of £35,000.
Primarily liability had already been admitted, but there was an allegation of contributory negligence, so we set about investigating that by obtaining a large file of papers from the Local Authority who had prosecuted the employer. We also set about making an application for an interim payment to assist the client financially and we were successful in securing £10,000 in that regard (followed by a further £10,000 a few months later).
We also set about finalising the medical evidence. It was necessary for the claimant to be re-examined by the hand surgeon following his treatment. We also arranged for the claimant to be examined by a psychologist in relation to his psychological symptoms and for him to attend an expert in prosthetics, for a report on how such things may assist him in the future.
It was clear that the claimant’s ongoing symptoms would have an impact on his ability to work, and therefore to earn. Therefore, we obtained details about his work history and his earnings and put together a comprehensive schedule of loss, which also included costs associated with care and assistance and other financial losses.
Once the medical evidence was complete, we were able to value the claim and enter into settlement negotiations. These negotiations ultimately resulted in an agreed settlement of £90,000, more than double the offer which was on the table when we began acting.
