The effects of such accidents can be far reaching for the injured person and their family.

The complicated rules governing such cases are found in the Fatal Accidents Act 1976 which has recently been amended to broaden its scope. This is because traditionally there has been little room for negotiation as the Act sets out what is covered, such as an award for bereavement (a fixed amount of £11,800) or the recovery of funeral expenses, and also limits who can claim and the amounts of compensation.

This is in addition to the fact that such accidents are very traumatic for everyone involved and may include people having to attend inquests into the accident and being involved with a coroner who may prepare a report.

If a partner or spouse is lost then usually there will be a financial strain placed on the survivor and this leads people to pursue claims under the Fatal Accidents Act.

As stated above there is a limit on who can claim, usually this is family and dependants (people who can show they were dependent on the deceased) such as spouses, parents and children. This has been expanded to cover people who may have been living with the deceased but who are not married often called civil partners or cohabiters.
